Attorney Kian Magana obtained a lowered charge as part of a plea deal for a medical professional charged with Driving Under the Influence out of the Van Nuys Courthouse.  Attorney Magana got the prosecuting agency to reduce the charge to an Exhibition of Speed (or “Speed Ex”), resulting in lowered penalties and less time on probation for his client.

Police claimed that Attorney Magana’s client had been driving at 85 miles per hour on the freeway, that the client performed poorly on Standardized Field Sobriety Tests (“SFTS”), and that the client’s BAC was measured at above a .08%.  Specifically, the client’s BAC was allegedly measured at .08% and .09%, which constitutes a violation of California Vehicle Code § 23152(b), commonly known as “Driving Under the Influence”.

Attorney Magana’s client was a medical professional who stood to lose his license if he were convicted of a DUI, so taking a DUI charge was unacceptable.  Attorney Magana’s client also could not accept a Wet Reckless (the most common DUI reduction, and more stringent than a Speed Ex) due to case-specific licensing issues.

Attorney Magana’s client had originally hired a different lawyer, but that lawyer was unable to negotiate a deal that the client could live with.  However, thanks to Attorney Magana’s experience prosecuting DUI cases, he was able to find sufficient problems of proof to convince the prosecuting agency that they might fail to convict at trial, and that a Speed Ex would be an appropriate disposition.

Because of his expertise and knowledge, Attorney Kian Magana was able to get a result that another lawyer couldn't get, while protecting his medical professional client’s licensure in the process.  Call The Law Office of KR Magana for a free consultation today!
