Attorney Kian Magana recently successfully got a case against his client *dismissed* after a motion to suppress evidence pursuant to Penal Code § 1538.5 in Downtown Los Angeles.

Kian’s client was arrested for allegedly being a felon in possession of a firearm, in violation of Penal Code § 29800(a)(1). Kian’s client was allegedly seen to be waiving a handgun, and purportedly pointed it at somebody, before allegedly stashing the firearm inside a car.

After the client’s arrest, officers searched the car without a warrant, relying on the “Search Incident to Arrest” exception to a warrant requirement.

Attorney Kian Magana filed a motion to suppress evidence, based on the theory that the warrantless search of the vehicle was a Constitutional Violation. At a contested hearing, the Court agreed with Attorney Kian Magana, and ruled that the gun and all evidence relating to the gun being found in the car needed to be excluded from evidence.
